SAN ANTONIO, Texas (Reuters) - Texas won a court victory on Monday in its effort to stop state funds under a health program for low-income women from going to clinics affiliated with Planned Parenthood, a group that provides abortions at some of its facilities.
A Texas judge allowed the state to go ahead with a revamped program for poor women, the Women's Health Program, that does not include Planned Parenthood.
Planned Parenthood said it does not provide abortions at clinics that participate in the state women's health program. But it is the nation's leading reproductive health and abortion provider and the state objects to its affiliations with clinics that do provide abortions.
"The court does not find that an irreparable injury will occur to Planned Parenthood," Visiting State District Judge Gary Harger ruled in a one-page order released Monday following a hearing last week. Harger said this would not be the last word on the case, with another judge set to take up the issue again in less than two weeks.
"We are pleased that the court rejected Planned Parenthood's latest attempt to skirt state law," said Lauren Bean, spokeswoman for state Attorney General Greg Abbott.
"The Texas attorney general's office will continue to defend the Texas legislature's decision to prohibit abortion providers and their affiliates from receiving taxpayer dollars through the Women's Health Program," Bean said.
Monday's ruling will allow the state-funded Women's Health Program to begin operations Tuesday as scheduled. The program will have more than 3,500 doctors, clinics and other providers, according to Linda Edwards Gockel, a spokeswoman for the Texas Health and Human Services Commission.
"We welcome Planned Parenthood's help in referring patients to providers in the new program," she said.
The case dates back to 2011, when a Republican super-majority in the Texas Legislature voted to refuse to allow any organization that provides abortion services or is affiliated with doctors who provide abortions from receiving taxpayer funding. But the state program was largely funded by the federal government.
When a federal appeals court ruled last summer that the so-called "affiliate rule" is unconstitutional, a "poison pill" inserted by the legislature ended the state's participation in the Medicaid-based program which used largely federal funding. It created the Women's Health Program using only Texas state funds, specifically outlawing funding for Planned Parenthood.
"I vehemently disagree with the state's efforts to blacklist a qualified provider and, thereby, interfere with a woman's right to choose her own provider," said Democratic state Rep. Donna Howard, a supporter of Planned Parenthood.
Sarah Wheat, interim co-CEO of Planned Parenthood of Central Texas, said the program was a lifeline for low income women to receive lifesaving health screenings.
"For sixty years this program has provided health screenings to women who otherwise would not have it, it has been a great federal-state partnership, it has saved taxpayer dollars, and Planned Parenthood has been a key part of this program from Day One," Wheat said.
Planned Parenthood says it has never used state tax money to pay for abortions, and using taxpayer money to fund abortions has been illegal in Texas for decades. But Howard says "extremist political influence" led to Planned Parenthood's exclusion.
Planned Parenthood said dozens of clinics across the state have been forced to close due to the ongoing tug-of-war over abortion.
Wheat says in many rural and inner city areas of Texas, Planned Parenthood operates the only clinics which provide basic health services for poor women, and excluding the group will mean that tens of thousands of the estimated 110,000 low-income women the new program aims to help will not be able to find an alternative provider.
Gov. Rick Perry, who fought for the bill excluding Planned Parenthood from the program, praised Monday's ruling.
"Today's ruling finally clears the way for thousands of low-income Texas women to access much-needed care, while at the same time, respecting the values and laws of our state," Perry said in a statement. "I applaud all those who stand ready to help these women live healthy lives without sending taxpayer money to abortion providers and their affiliates."

What in the name of Zeus does the GOP think it?s going to achieve by bargaining with Barack Obama and his socialist posse? Instead of pretending we have much in common, why don?t the Republicans get a clue and listen to the results of the last election, and heed Conservatism?and allow liberals to keep?listening to Prozac? It is time to use the ancient Roman act of?Damnatio Memoriae, or public condemnation, to bury old Barack along with all his self-indulgent and imbecilic decisions. The following article explores this option.
The phrase ?Damnatio Memoriae? means ?posthumousdenigration.? It is a Latin phrase which loosely translates to historical censure, or to be blotted from the official record. The Romans did this punishment to the emperors they considered to be truly abysmal and worthy of the worst ends. This execration was more lowly than death because of the high esteem Romans paid to fame and immortality achieved through noble deeds. Egyptians also practiced a similar kind of posthumous denigration, as well as the?Holy Roman Church. The USSR also practiced this art with great vigor.
Classicist N.S. Gill?writes about this practice,
The Latin term?damnatio memoriae ?condemnation of the memory? is modern, but is used to describe a variety of ancient Roman processes dealing with individuals judged unfit to be members of a community. Such undesirables include traitors, would-be tyrants, and individuals who were enemies of Rome, according to Harriet I. Flowers. This posthumous dishonor was considered the worst that could be done to a former senator.
This act was done by an official vote of the senate, or also unofficially by another emperor?s whim, and then fulfilled through every manner available. For the person posthumously denigrated, their statues would be?destroyed or defaced, their?coinage melted down, paintings desecrated,?inscriptions from across the Empire defiled, and their?name blotted out of historical records.
Gill continues,
Acts subsumed under the rubric of ?damnatio memoriae? include scratching names and titles from inscriptions, defacing likenesses, banning the condemneds? wax masks from funerals, confiscation and destruction of the condemned man or woman?s writing, annulling of wills, marking the birthday of the condemned as a day of ill-omen, marking the anniversary of the condemned?s death with thanksgiving, mutilation of corpses, and more. The condemnations could be started by the Senate, the emperor, or the army.
Emperors who were historically?blotted from the official record included Caligula and Nero.
This?historical scrubbing of figures out of the public record was done by the USSR, not surprisingly. If a politician or military figure fell out with Stalin, or another leader, he could be totally?removed from every photograph or official record. This then?happened to Stalin himself, and Lenin?who had their statutes removed from many public places.
A very recent example of this type of historical censure have been seen in Canada where the?top Canadian military commander, Colonel Russell Williams, was found guilty of murdering two women, and abusing 88 others. The Canadian military decided not to simply recycle his old uniforms but?to burn them so as to never be worn by any other member. His crimes were of a?sexual fetishist nature, bringing great shame upon the military.

Why was this historical censure done upon Roman emperors, the most powerful men in the ancient world? Classical Rome was a place which took great pride in doing things the right way. Public service, and especially elected office, was considered the high point of Roman existence, before the Empire was established. But to do things the wrong way was shameful and society felt a need to publicly address these evil deeds.Damnatio Memoriae was officially established after the Republic ended, but the idea behind it was in keeping with republican principles. The theory was that no scoundrel or criminal should be honored by history who attacks the very country which gives him fame, honor and sustenance. So let it be for Obama.
Principled reasons for canceling and reversing Obama legislation ought be done on the following grounds:
First, those decisions made against our Declaration and Constitution and laws.
Second, those choices?made in opposition to the?obvious will of the people, since ourDeclaration condemns this practice: ?Governments are instituted among Men, deriving their just powers from the consent of the governed??
Third, acts which clearly go against the best interest of all Americans.
Fourth, choices aiding foreign governments at the cost of America or her allies.
Fifth, commands which elevate Islam over other religions. Let?s not forget we are at war with its radicals.
Sixth, acts which are simply unpatriotic.
Seventh, legislation which undermines our capitalist form of economy.
Eighth, choices that harm our armed services.
Ninth, declarations or acts that denigrate America.
Tenth, legislation which weaken America?s sovereignty in the interest of world bodies.
Following is a truncated list of laws and decisions by Obama & Administration that ought be stricken from the record. Plea feel free to add to this short number, as there are hundreds more.
A large majority want this bill completely eviscerated.?It is unconstitutional and willbadly damage the quality and access of American healthcare. A shocking?74% of doctors may quit medicine because of it.
TARP was an?unconstitutional taking of American funds, arbitrarily given to businesses without any accountability.
Detroit car maker?bailout was an illegal buying of?private businesses with public fundswhich created de facto socialist results.
The Stimulus bill was?wasted funds not even invested in infrastructure, but doled out as tasty pork medallions to countless Democratic constituents, while a trillion dollars drain from our money supply.
Despite the science behind this idea being?utterly exposed as fraudulent, Obama resolutely still attempts to address it legally. He might as well demand laws to protect Little Bo Peep, while he?s at it.
This legislation would?wildly prune America?s economy, done in the name of an already failed Global Warming theory. It is really a?global Marxist ruse to redistribute wealth. The?UN admits it?s socialism.

We cannot wipe out anyone?s existence in the US like was done in ancient Rome, or during the communist regime of the USSR. But we can decisively repudiate the lawless reign of tin-horn tyrant Barack Obama by canceling all of his horrible legislation.
But is this really necessary, anyway? Wasn?t Obama chastened by the last election results? In a word, No! Contra?because, at some level?to save the standards in this country, a public repudiation must be done in some manner, to reestablish democracy, capitalism, the Bill of Rights, and American sovereignty. In other words, teaching future would-be tyrants that America is the land of the free and home of the brave; not the place of brainless imposters who would be depots, is a lesson we desperately need to establish today.
In particular, the Obama legacy must be challenged, including running a campaign that received hundreds of millions in anonymous global funds over the Internet, a tawdry fact never investigated. Campaign irregularities involving ACORN were also observed across the US, some of which helped catapult Al Franken into office for Barack?s supermajority, used for Obamacare. Obama also employed a remarkable barrage of lies to help himself enter office, Chicago style.
Barack must also be condemned for his insipid ?Cabinet,? a staff of leftist toadies nearly as incompetent as he. Elfish Tim Geithner is a prime example, as well as the rodent-like and spectacularly condescending David Axelgrease. Add ham-fisted media-bear spokesperson Bobby Gibbs, and Rahm ?Ram-Beau? Emanuel, ballet student turned politician. All of these come to mind as outlandish misfits. Too bad town square stockades and public floggings are out of style.
Three major flaws of Obama?s present themselves when considering a need for public censure of this colossal misfit: Honesty, Competence and Orientation. First, Barack has such a problem telling the truth that at some point we must suspect he probably doesn?t understand the concept, for starters. For this he needs psychiatric evaluation.
Second, in no possible universe does Barack even begin to measure up to the most basic level of competence for his role as leader. So the 900 pound donkey in the room is?Why did Obama even decide to run for president??Even he admitted he was utterly unqualified by reason of education and experience. Not only was Obama unfit to lead when elected?doesn?t it seem like he has actually devolved since his ascension? It?s time to put down the golf bag and basketball and start studying world history, economics, American constitutional development, and many other subjects for this lazy vagabond of a POTUS.
The most worrisome aspect of Obama?s worldview, believe it or not, is not his dishonesty or incompetence?but his political orientation. Why does everything have to be leftism, socialism or communism to slake his avaricious leadership style? He?s like a robot programmed by Marx, used to deliver pamphlets for the ACLU.
Let?s throw Obama out of office and begin the enjoyable task of a total repudiation of his Marxist agenda. If anything will get the attention of progressive Americans who are bizarrely trying to torpedo their own ship, this action will do the trick.
Every one of the above bad laws and decisions was fomented by obdurate Obama, either through ignorance, ill-will, or red-eyed Marxist fervor. There are so many bad decisions by Barack, and so few good, he cannot simply be treated as another failed leftist president. He must be singled out as almost uniquely wicked, publicly condemned and shamed into permanent exile. Otherwise, how else will our children learn to oppose misuse of public offices and funds, while detesting smooth liars?
Publicly condemning Obama is no different than any other kind of calling out wickedly unacceptable public behavior. Barack needs to be disciplined and put in his place just like the bully on the block collecting other kid?s lunch money. Unless the bad politicians of America see Obama put in his place decisively after his giant folly, it will only embolden them, and then we truly will have hell to pay.

WASHINGTON (AP) ? An animal rights group will pay Ringling Bros. and Barnum & Bailey Circus $9.3 million to settle its part of a lawsuit stemming from claims the circus abused its elephants.
The circus company's owners announced the settlement with the American Society for the Prevention of Cruelty to Animals on Friday. The animal rights group was one of several that in 2000 sued the circus' owner, Feld Entertainment Inc., claiming elephants were abused. Courts later found that the animal rights activists had paid a former Ringling employee to bring the lawsuit and that the man didn't have the right to sue the circus.
The Vienna, Va.-based Feld Entertainment then sued the animal rights groups, accusing them of conspiracy to harm its business other illegal acts. Friday's settlement covers only the ASPCA.

Since the shootings at Sandy Hook Elementary in Newtown, Conn., on Dec. 14, we at Slate have been wondering how many people are dying from guns in America every day.
That information is surprisingly hard to come by. The Brady Center to Prevent Gun Violence, for example, has a tally atop its website of ?people shot in America.? That number, though, is an estimate, based on the number of gun injuries and deaths recorded by the CDC in 2008 and 2009, the most recent years for which statistics are available. It seems shocking that when guns are in the headlines every day, there?s no one attempting to create a real-time chronicle of the deaths attributable to guns in the United States.
Well, someone is. Since this summer, the anonymous creator of the Twitter feed @GunDeaths has been doing his best to compile those statistics, tweeting every reported death he can find. He was inspired, he told us in a phone interview, by the Aurora, Colo., shootings and simply wanted to call daily attention to the toll that guns take. Now Slate is partnering with @GunDeaths to create this interactive feature, ?Gun Deaths in America Since Newtown.?

In Altoona, Iowa, Christmas came early for one local family.
Ruby Modlin was at a local Walmart with her family shopping for some holiday groceries when an anonymous man picked up their $211 bill, KCCI 8 Des Moines reports. Modlin had noticed the man following them around the store, but wasn't sure of his intentions until he stepped in to swipe his card at the checkout. The "secret Santa" handed her the receipt and wished her a Merry Christmas before leaving with his own family.
The holiday gift was particularly special for Modlin, who has been in and out of the hospital in recent months due to liver failure, according to KCCI 8.
When it comes to charitable giving, nothing trumps the holiday season. At a Walmart store in Hastings, Mich. last week, an anonymous donor wrote a $10,000 check to pay off 43 customers' layaway accounts. One woman fainted when she was told her bill was paid for.
In Palm Beach Gardens, Fla., another "secret Santa" similarly requested to donate $10,000 to pay for strangers' layaway accounts at Toys R Us.

It wasn?t enough for a wealthy Missouri businessman to write a check. The ?Secret Santa,? who did not reveal his name to the press, trekked up to New Jersey and New York to personally dole out $100 bills to Hurricane Sandy victims who are just starting to put their lives back together, the AP reports. <a href="http://www.huffingtonpost.com/2012/11/30/secret-santa-sandy_n_2215717.html">Altogether, he?s giving away $100,000 this holiday season</a>. "It's about the random acts of kindness," the benefactor told the AP. "I'm just setting an example, and if 10 percent of the people who see me emulate what I'm doing, anybody can be a Secret Santa!"
It?s become the uplifting image of the season. When Officer Larry DePrimo saw Jeffrey Hillman shivering on the streets of New York City without a pair of shoes, <a href="http://www.huffingtonpost.com/2012/11/30/boot-buying-nypd-cop-larry-deprimo_n_2218650.html">he spent $75 of his own money to buy the panhandler a pair of boots</a>. When Alan Dent stumbled upon a purse filled with credit cards and cash, the homeless man knew exactly what to do. The British man brought it to Barclays bank so it could be reunited with its customer. Once a local charity caught wind of Dent?s act of kindness, it offered to find him a home, which he may get in time for Christmas, <a href="http://menmedia.co.uk/manchestereveningnews/news/s/1596441_home-for-christmas-charity-offers-manchester-city-centre-busker-who-handed-in-lost-purse-a-place-to-live">the Manchester Evening News reports.</a>
Curtis Butler, III is by no means rich, but the formerly homeless vet used whatever funds he could to help those less fortunate than he, <a href="http://www.11alive.com/news/article/267012/40/Once-homeless-vet-steps-foward-to-pay-power-bills-for-others">11 Alive reports.</a> When the Butler saw that a number of customers couldn?t pay their power bills at Georgia Power earlier this month, he decided to cover the expense for 20 customers. Across the country, benevolent customers are making sure that shoppers can shop for their loved ones, without having to stress about how they will afford it after. MOSCOW (Reuters) - Russian President Vladimir Putin said on Thursday he saw no reason not to sign a bill into law that would ban Americans adopting Russian children and promised measures to improve care of his country's orphaned youngsters.
Although Putin said he would need to study the final text of the bill, the comments were the strongest indication yet that he will approve the adoption ban legislation, which has strained U.S.-Russia relations.
Parliament gave its final approval on Wednesday to the bill that would also bring in other measures in retaliation for new U.S. legislation designed to punish Russians accused of human rights violations.
"So far I see no reason not to sign it, although I have to review the final text and weigh everything," Putin said in televised remarks at a meeting of senior federal and regional officials.
"I am ready to sign not only the law ... but also a presidential decree that will modify the support mechanisms for orphaned children ... especially those who are in a difficult situation, by that I mean in poor health," Putin said.
Critics of the bill say Russia is playing politics with the lives of children. Child rights advocates say children in Russia's crowded and troubled orphanage system will have less of a chance of finding homes if the bill becomes law.

Update: We've done some digging, and the WiFi may be more innocuous: Sonos' proprietary network is actually WiFi that's just invisible most of the time. Android users have access to settings that expose Sonos' WiFi network and make it usable. As such, the Playbar may be more conventional than first thought, although its exact role in the home is still a mystery.

No one thinks damaging coral is sexy, but researchers from the University at Buffalo just made it official. Turns out, coral sex is dampened after injury from storms and human activity.
Their study shows that while coral adapts to injury events by initially growing back rapidly, reproduction rates are suppressed up to four years after initial injury. This is particularly alarming since size, rather than age, dictates coral's health and maturity, explained study leader Howard Lasker.

Many coral have asexual and sexual reproduction, the latter usually a wild sex party of sorts, where corals release sperm and eggs into the water at a precise time. Those sex gametes hook up with each other, from different individuals, to produce free-floating larvae called planulae.
Lasker and his team studied coral colonies in the Bahamas that were being harvested for use in skin care products. They found that even years after harvest spermaries (coral sperm colonies) and polyps, where coral stores eggs, were underproducing.
"On the science side of it, this really raises the question, 'Well, what's going on?'" Lasker told LiveScience. "This is a healthy-looking colony, those wounds [from harvesting] are long, long healed, so what's different about it? And that's something we're still puzzling over."
Christopher Page, Lasker's co-author and now a staff biologist at Mote Marine Laboratory, believes that in the face of a changing environment coral's ability to reallocate resources after injury events shows promising adaptability.

"Coral are more adaptable than we may have thought in the beginning, but that doesn't mean they'll persist despite changes," Page told LiveScience.
When energy is given to one resource ? in this case, quick regrowth after injury ? it's taken from another, Page explains. This leaves more persistent effects than were previously suspected ? in this case, long-term, slowed reproduction.
The findings have implications for future coral health. While researchers had previously thought coral rebounded heartily after injury events, such as those incurred from hurricanes and other storms as well as human activity such as boating, this study reveals that populations cannot rebuild as quickly as hoped. But the most effective way to protect coral continues to be the cessation of injury events altogether.
"When there's damage, that damage has a longer-term effect than we may have initially envisioned, but the more significant factor is that initial damage," said Lasker. Coral is a particularly sensitive creature, affected by a host of climate change-related events from increased water temperature to more frequent and severe storms. And now, research reveals that it is difficult to predict how these marine animals will react to injury, since changing variables will determine their health and growth.
To conserve and protect coral, explained Page, we must both avoid their continued injury, and examine our restoration approaches to consider long-term effects of damage as well as the significant adaptability of these organisms. If a multifaceted and focused approach to management is taken, coral, threatened worldwide, may just be able to revamp its sex life.
Many corals are hermaphroditic broadcast spawners, meaning they release packets of sperm and eggs into the water.
Warming waters signal the coral that it's time to start producing sex cells, then a precise combination of daylight and moonlight trigger the sudden, simultaneous release of eggs and sperm.

NEW ORLEANS (AP) ? Freezing rain and sleet made for a sloppy Christmas trek in parts of the nation's midsection, while residents along the Gulf Coast faced thunderstorms, high winds and tornadoes that were doing damage in some areas.
Winds toppled a tree onto a pickup truck in the Houston area, killing the driver. Icy roads already were blamed for a 21-vehicle pileup in Oklahoma, where authorities warned would-be travelers to stay home.
Trees fell on a few houses in central Louisiana's Rapides Parish but there were no injuries reported so far and crews were cutting trees out of roadways to get to people in their homes, said sheriff's Lt. Tommy Carnline. Possible damage also was reported near McNeil, Miss.
Fog blanketed highways, including arteries in the Atlanta area where motorists slowed as a precaution. In New Mexico, drivers across the eastern plains had to fight through snow, ice and low visibility.
At least three tornadoes were reported in Texas, though only one building was damaged, according to the National Weather Service. Tornado watches were in effect across southern Louisiana and Mississippi.
More than 180 flights nationwide were canceled by midday, according to the flight tracker FlightAware.com. More than half were canceled by American Airlines and its regional affiliate, American Eagle.
American is headquartered and has its biggest hub at Dallas/Fort Worth International Airport.
Christmas lights also were knocked out with more than 70,000 people without power in east Texas, Arkansas, Mississippi and Louisiana.
Meanwhile, blizzard conditions were possible for parts of Illinois, Indiana and western Kentucky with predictions of 4 to 7 inches of snow. Much of Oklahoma and Arkansas braced under a winter storm warning of an early mix of rain and sleet forecast to eventually turn to snow. About a dozen counties in Missouri were under a blizzard warning from Tuesday night to noon Wednesday.
Some mountainous areas of Arkansas' Ozark Mountains could get up to 10 inches of snow, which would make travel "very hazardous or impossible" in the northern tier of the state from near whiteout conditions, the National Weather Service said.
The holiday may conjure visions of snow and ice, but twisters this time of year are not unheard of. Ten storm systems in the last 50 years have spawned at least one Christmastime tornado with winds of 113 mph or more in the South, said Chris Vaccaro, a National Weather Service spokesman in Washington, via email.
The most lethal were the storms of Dec. 24-26, 1982, when 29 tornadoes in Oklahoma, Missouri, Arkansas, Tennessee and Mississippi killed three people and injured 32; and those of Dec. 24-25, 1964, when two people were killed and about 30 people injured by 14 tornadoes in seven states.
Quarter-sized hail reported early Tuesday in western Louisiana was expected to be just the start of a severe weather threat on the Gulf Coast, said meteorologist Mike Efferson at the weather service office in Slidell, La.
Storms along the Gulf Coast could bring winds up to 70 mph, heavy rain, more large hail and dangerous lightning in Louisiana and Mississippi, Efferson said. Furthermore, warm, moist air colliding with a cold front could produce dangerous straight-line winds.
The storm was moving quickly as it headed into northeast Louisiana and Mississippi into the late afternoon and early evening, said Bill Adams at the weather service's Shreveport, La., office.
In Mississippi, Gov. Phil Bryant urged residents to have a plan for any severe weather.
"It only takes a few minutes, and it will help everyone have a safe Christmas," Bryant said.
